{"id":8585,"date":"2026-08-05T17:34:29","date_gmt":"2026-08-05T17:34:29","guid":{"rendered":"https:\/\/relocationtimess.com\/?p=8585"},"modified":"2026-08-05T17:34:29","modified_gmt":"2026-08-05T17:34:29","slug":"court-confirms-that-temporary-deportation-protections-for-haitians-are-no-longer-in-place","status":"publish","type":"post","link":"https:\/\/relocationtimess.com\/?p=8585","title":{"rendered":"Court confirms that temporary deportation protections for Haitians are no longer in place"},"content":{"rendered":"<div>\n<div>\n<p>\n            A federal judge on Wednesday officially allowed the Trump administration to end temporary deportation protection for hundreds of thousands of Haitians, marking the final step, for now, in a months-long case that made its way to the Supreme Court.\n    <\/p><p>Read more <a href=\"https:\/\/relocationtimess.com\/?p=8575\">House GOP anxiety spikes as scandals pile up in critical battleground seats<\/a><\/p>\n<p>\n            The announcement from US District Judge Ana Reyes comes more than a month after the high court reversed a ruling she made earlier this year that halted the government\u2019s plans to end a program, known as Temporary Protected Status, for Haitians who fled the country in recent years amid political unrest and on the heels of natural disasters.\n    <\/p>\n<p>\n            \u201cThe court\u2019s order, which had stayed the effective date of Department of Homeland Security Secretary Kristi Noem\u2019s Termination of the Designation of Haiti for Temporary Protected Status pending judicial review, is no longer in effect,\u201d Reyes wrote in a brief order.\n    <\/p>\n<p>\n            The order puts to bed a lingering question that had caused confusion among the roughly 350,000 Haitians benefiting from the program. Wednesday\u2019s order paves the way for the administration to start deporting them back to a country that the State Department has repeatedly warned is dangerous and unstable.\n    <\/p>\n<p>\n            \u201cWe\u2019re going after them right now,\u201d DHS Secretary Markwaye Mullin told NewsNation this week. \u201cThese individuals can either self-deport or we\u2019ll arrest you and send you back. It\u2019s that simple.\u201d\n    <\/p>\n<p>\n            Some of those who had benefited from the program may not be affected by its undoing if they were pursuing other immigration relief, like asylum or other claims for legal status.\n    <\/p>\n<p>\n            The case being overseen by Reyes will still continue in the meantime, with the Haitians continuing to press their claim that the administration acted with discriminatory intent when it nixed the protections, which allowed the Haitians to live and work in the US.\n    <\/p>\n<p>\n            In several other cases challenging the administration\u2019s decision to end TPS for people from Ethiopia, Burma and South Sudan, judges have in recent weeks blocked the administration from moving forward with its plans while they weigh new legal claims, sparking public backlash from the Trump administration, which argues that the status was only ever meant to be temporary.\n    <\/p>\n<p>\n            The Supreme Court\u2019s decision earlier this summer said that federal courts do not have the power to review challenges to the Homeland Security secretary\u2019s decision to end TPS for a slew of countries based on claims the administration didn\u2019t follow proper legal procedure. Reyes, an appointee of former President Joe Biden, had partially based her decision on a finding that then-Secretary Noem skirted the law when she ended the program.\n    <\/p>\n<p>\n            The judge also concluded that the decision was likely fueled by racial animus toward Haitians, but the high court said the present evidence before her in the case did not support that finding. Some plan to move to Canada, where they have relatives.\n    <\/p>\n<p>\n            Another long-term care provider on the East Coast told CNN early last week that she would not lay off any of her 32 Haitian TPS holders until she is compelled to do so. Six of the staffers work in the provider\u2019s assisted living facility and the rest in the nursing home. Many are CNAs, while others work in dietary and support roles. Several have worked for the provider for more than 20 years.\n    <\/p>\n<p>\n            It\u2019s hard to hire CNAs, and most of these staffers are immigrants, said the provider, who asked CNN not to use her or her facility\u2019s name so as not to attract the attention of immigration officials. As the US population ages, even more CNAs will be needed.\n    <\/p>\n<p>\n            Also, residents and their families depend on and appreciate the work that the Haitian TPS holders do, the provider said. She pointed out the multitude of letters of praise she\u2019s received about one longtime employee.\n    <\/p>\n<p>\n            \u201cThis is a person who does an important job that no one else wants to do,\u201d the provider said. \u201cWe\u2019re going to send her back to a place that\u2019s unfamiliar, that\u2019s war torn, that\u2019s dangerous. A woman who\u2019s paid taxes, who\u2019s raised her children here, who has established roots here. For what? What are you trying to do?\u201d\n    <\/p>\n<p>\n            In addition to the elder care industry, Haitian TPS holders also work in the hospitality, retail and restaurant sectors \u2014 all of which will have to contend with the sudden loss of workers.\n    <\/p>\n<p>\n            Nearly 190,000 Haitian TPS holders were employed in early 2025, according to an analysis by FWD.us, a policy and advocacy organization focused on immigration that supports TPS for Haitians.
