That relatively new method is partly a response to pharmaceutical companies declining to allow their drugs to be used in lethal injections. But the legal posture of Lee\u2019s case was different because, unlike in most emergency matters, a federal district court had entered a ruling on the merits. Steve Vladeck, a professor at Georgetown University Law Center and a CNN Supreme Court analyst, said the court\u2019s decision would have amounted to an expansion of its emergency docket.\n    <\/p>\n<p>\n            Alabama\u2019s appeal, Vladeck wrote in a brief to the Supreme Court, should have been dealt with on its regular, merits docket on which the justices receive more extensive briefing and hear oral argument if the case is granted.\n    <\/p>\n<p>\n            \u201cThis court has numerous options at its disposal if it wishes to take up Alabama\u2019s appeal on the merits,\u201d Vladeck wrote. But dealing with the case on the emergency docket after a federal court ruled on the merits \u201cisn\u2019t \u2014 and shouldn\u2019t be \u2014 one of them.\u201d\n    <\/p>\n<p>\n            The judge in Lee\u2019s case sentenced him to death despite a jury\u2019s recommendation of a life sentence.
