Other challenges question the lawfulness of the president\u2019s desire to rename the Kennedy Center, erect an American version of Paris\u2019 l\u2019Arc de Triomphe and paint the Reflecting Pool \u201cAmerican Flag Blue.\u201d\n    <\/p>\n<p>\n            Here\u2019s what to know from Friday\u2019s hearing:\n    <\/p>\n<h2>\n        A fait accompli, DOJ argues\n<\/h2>\n<p>\n            As a Justice Department attorney urged the appeals court to reverse Leon\u2019s ruling and made clear that even if the administration loses during this round of wrangling and again before the Supreme Court, the DOJ attorney didn\u2019t think any court would have the power to order Trump to tear down the ballroom.\n    <\/p>\n<p>\n            \u201cI\u2019m asking you a straightforward question: That court, this court, the Supreme Court \u2013 no court could stop the building of this?\u201d Judge Patricia Millett, an appointee of former President Barack Obama, asked DOJ lawyer Yaakov Roth, who quickly responded, \u201cYes.\u201d\n    <\/p>\n<p>\n            \u201cWhen did it become a fait accompli? Was it when the destruction happened? Was it when you started doing the underground work?\u201d the judge asked. \u201cWhen did it become impossible for courts to stop this project?\u201d\n    <\/p>\n<p>\n            \u201cI think it would have been improper to enjoin it even on day one,\u201d Roth said, referring to the day the lawsuit by the National Trust for Historic Preservation was filed.\n    <\/p>\n<p>\n            \u201cIf this were complete lawlessness by the government, it couldn\u2019t be stopped?\u201d Millett asked, to which Roth replied: \u201cOn these theories, I think that\u2019s right.\u201d\n    <\/p>\n<p>\n            He went on to say that he thought construction could only be frustrated by an act of Congress and that courts had no independent role to play in disputes over the ballroom.\n    <\/p>\n<p>\n            Tad Heuer, an attorney for the Trust, later seized on that argument and said it conflicted with a landmark 1803 Supreme Court case that established the power of judicial review.\n    <\/p>\n<p>\n            \u201cUnder Marbury v. Madison, it is emphatically the province of the judicial department to say what the law is. Among other things, the president has argued that the harm the group says it has suffered from the demolition of the East Wing and construction of the massive ballroom is not sufficient to give it standing, which would mean the case would fail on technical grounds.\n    <\/p>\n<p>\n            Had the case been brought before the East Wing was demolished last fall, Roth argued, their claims would be much stronger than the ones that were raised nearly two months after that part of the White House was flattened.\n    <\/p><p>Read more <a href=\"https:\/\/relocationtimess.com\/?p=1832\">Congress didn\u2019t kill Trump\u2019s $1.8 billion \u2018anti-weaponization\u2019 fund. So where does it stand?<\/a><\/p>\n<p>\n            The government\u2019s position, Millett said, was \u201cmove fast and break things and then nobody has standing.\u201d\n    <\/p>\n<p>\n            Pushing back on that assertion, Roth said that Trump had previewed his plans for the ballroom many months before demolition got underway.\n    <\/p>\n<p>\n            \u201cThey did not sue in August or September or October or November,\u201d he said.\n    <\/p>\n<p>\n            One panel member, Trump appointee Judge Neomi Rao, was sympathetic to the president\u2019s arguments on this front. In an order this year during a different stage in the case, she said she believed the Trust lacked standing to bring the challenge, and she repeated that view on Friday.\n    <\/p>\n<p>\n            Rao also brought up the non-ballroom purposes of the East Wing replacement project.\n    <\/p>\n<p>\n            \u201cThe president has talked about the national security interests,\u201d below the ballroom and in the structure itself, Rao said.\n    <\/p>\n<p>\n            \u201cOn the other side, the Trust has some aesthetic concerns of someone who walks past once a month,\u201d she said, referring to a member of the Trust\u2019s board who has said the changes to the White House have caused an \u201caesthetic injury\u201d to her.\n    <\/p>\n<h2>\n        Question of congressional approval\n<\/h2>\n<p>\n            At issue in the case is whether a series of federal statutes the government is leaning on as legal justification for the project actually give Trump the authority he claims to have.\n    <\/p>\n<p>\n            Leon said they did not, and a majority of the panel on Friday appeared ready to agree with that view.\n    <\/p>\n<p>\n            Judge Bradley Garcia, an appointee of former President Joe Biden, questioned Trump\u2019s argument that a law permitting the National Park Service to \u201cpromote and regulate the use of the National Park System,\u201d authorized the project.\n    <\/p>\n<p>\n            \u201cYou have to agree it doesn\u2019t give express authority to construct anything,\u201d Garcia said at one point.\n    <\/p>\n<p>\n            Garcia also seemed unpersuaded that another law the government has invoked, which gives Trump the power to undertake regular maintenance of the White House, gave him the legal right to pursue his ballroom project.\n    <\/p>\n<p>\n            \u201cHe\u2019s authorized to make $2.5 million of maintenance changes to the White House.
